You do not always need council approval to install or replace a hot water system in Sydney. The work may be exempt development if it meets all current NSW planning requirements, but approval may be necessary because of the location, property constraints or associated building work.
When might approval be required?
Check the approval pathway if:
- the system is being relocated rather than replaced in the same position
- structural work or rooftop equipment is involved
- a heat-pump unit may affect boundary setbacks or noise limits
- the property is heritage-listed or subject to other planning controls
- the installation cannot meet every relevant exempt-development condition.
Changing the energy source does not automatically require council approval. However, it may involve separate licensed plumbing, gasfitting or electrical work.
How to check before installation
- Check NSW planning rules: Review the current exempt-development provisions through the NSW Planning Portal. Confirm that every condition applies to the proposed system, location and associated work.
- Check the property: Use the Planning Portal’s property information tools and contact the relevant council if the site has heritage, zoning or other mapped constraints. Provide the exact equipment details and proposed location.
- Confirm the scope with the installer: Ask which planning requirements apply and whether structural, plumbing, drainage, gas or electrical work is included. Obtain any required approval before work begins.
- Verify licences and documents: Check trade licences through NSW Fair Trading. Ask the relevant licensed tradespeople which notices, certificates and commissioning records must be provided for the completed work.
Planning approval and trade compliance are separate: work may be exempt development but still require licensed tradespeople and prescribed documentation.
Do not modify gas, electrical, pressurised-water or roof-mounted services yourself. Roof access also presents a fall risk. Limit your actions to safe observation and occupant isolation controls, then use appropriately licensed tradespeople.
