Council approval is generally not required when relining is confined to an existing private drain within private property. Approval or consent may be required if the work affects Sydney Water infrastructure, a council asset, public land, a road reserve, a shared connection or a heritage-controlled property. Requirements must be confirmed for the site before work begins. First confirm who is responsible for the affected pipe in Sydney, because ownership affects which authority can consent.
When approval may be required
Check with the relevant authority if the work may affect:
- a Sydney Water sewer main, maintenance structure or other network asset
- a shared connection where ownership or control is unclear
- a council-owned stormwater pipe, pit or structure
- a footpath, road, road reserve or other public land
- a heritage-listed property or protected heritage fabric
- associated building or development work requiring separate consent.
A property boundary does not necessarily establish pipe ownership. Private drains usually connect a property to the sewer network, while Sydney Water, councils or other parties may control downstream, shared or stormwater assets. Trenchless work is not automatically exempt from approval requirements.
Who should confirm the requirements?
An appropriately licensed plumbing or drainage contractor should first identify the pipe’s location, function and likely ownership using available drainage records and suitable inspection or locating methods.
Depending on the findings, requirements should then be confirmed with:
- the relevant local council for council assets, public land, local roads or planning controls
- Sydney Water for work that may affect its sewer network
- the relevant road authority for occupation or work within a road reserve
- the council or Heritage NSW where heritage controls may apply.
The absence of council approval does not remove plumbing compliance requirements. The contractor should confirm any applicable notices, inspections and compliance documentation before starting. Do not access sewer infrastructure, excavate near concealed services or attempt drainage work yourself. Sewage, live utilities and regulated plumbing systems require appropriate safety controls and licensed contractors.
